In the event of an auto accident or truck accident, a personal injury victim can recover for his or her medical bills from their own insurance policy if they have medical payments coverage. A quick check of the policy declarations page will reveal if the coverage is available. Typically, the coverage is just a few thousand dollars, but I have seen coverage as high as $25,000 when there are multiple vehicles or policies. Payments made as a result of this coverage are not included in a personal injury case recovery. Unfortunately, many insurance companies are trying to factor in this coverage in making settlement offers to injury victims. However, the law is clear that a defendant in a Virginia personal injury claim is not entitled to the benefit of the personal injury victim's own insurance.
